Nothing in this policy affects or limits your statutory rights under applicable Irish or EU consumer law.
If you change your mind and wish to cancel your order before it has been dispatched, please contact us as soon as possible.
Where we are able to stop the order before dispatch, we will cancel it and issue a full refund without a delivery or return charge.
If you are a consumer purchasing online or by phone, you generally have the right to cancel an eligible order without giving a reason.
For most eligible purchases, you may notify us that you wish to cancel at any time from placing your order until 14 days after you, or a person nominated by you, receive the goods.
To exercise your right to cancel, you must inform us clearly of your decision to cancel. You can do this by email, telephone or another clear statement.
Once you have notified us of your decision to cancel, you must generally return the goods to us without undue delay and no later than 14 days after notifying us of your cancellation.
Certain products may be excluded from the statutory right to cancel where permitted by law, including certain personalised goods, goods that deteriorate or expire rapidly and certain sealed goods that are not suitable for return for health or hygiene reasons once unsealed.
You may notify us that you wish to cancel an eligible order even if it has already been dispatched.
However, once an order has been dispatched, the parcel may need to be recalled or returned to us.
You will be responsible for the direct cost of returning the goods to us following a change-of-mind cancellation, except where applicable law requires otherwise.
If your parcel is already in transit and you ask us to arrange for our courier to recall and return the shipment to us, the direct return cost charged to us by the courier may be deducted from your refund.
This applies where the cancellation is a change of mind and the order is otherwise being fulfilled correctly.
If the cancellation arises because goods are faulty, damaged, incorrect or otherwise do not conform to the contract, different rules apply as outlined below.
Where you exercise a statutory right to cancel an eligible distance purchase, we will refund the cost of our standard delivery service where required by law.
If you expressly selected a more expensive delivery method than our least expensive standard delivery option, we are not required to refund the additional amount paid for that upgraded delivery service.
The direct cost of returning the goods to us remains your responsibility in a change-of-mind cancellation, where applicable.

Please package returned goods carefully and appropriately to protect them during transit.
You are responsible for taking reasonable care of the goods while they are in your possession and during the return process.
You may inspect goods to the extent reasonably necessary to establish their nature, characteristics and functioning. However, you may be responsible for any reduction in value resulting from handling beyond what is reasonably necessary for this purpose.
Because many of our products are glass bottles and other fragile items, we strongly recommend using appropriate protective packaging and a suitable delivery service when returning an order.
In addition to your statutory rights, Martin's Off-Licence offers customers a 30-day change-of-mind returns period from the date the goods are received.
For returns made outside the statutory cancellation period but within our additional 30-day returns period, goods must be returned unused, unopened, in a resalable condition and, where applicable, in their original packaging.
You will be responsible for the direct cost of returning goods under our 30-day change-of-mind returns policy.
This additional 30-day policy does not replace or restrict any statutory rights you may have.
Please contact us before returning goods so that we can advise you on the appropriate return arrangements.
Where you exercise your statutory right to cancel, we will process the refund without undue delay and in accordance with the time limits required by applicable consumer law.
For sales contracts, we may withhold the refund until:
We have received the goods back; or
You provide satisfactory evidence that the goods have been returned,
whichever occurs first.
Unless otherwise expressly agreed, refunds will be made using the same payment method used for the original transaction.
Where applicable, any direct return cost payable by you and charged to us for arranging a courier recall or return may be deducted from the amount refunded.
If an item arrives damaged, faulty, incorrect or otherwise does not conform to what you ordered, please contact us as soon as reasonably possible.
Where possible, we may ask you to provide photographs of damaged goods and packaging. This helps us investigate damage with our delivery partners and resolve the issue as quickly as possible.
Where goods are faulty, damaged, incorrect or otherwise do not conform to the contract, we will provide the appropriate remedy in accordance with your statutory consumer rights.
You will not be required to bear return costs where applicable consumer law requires those costs to be borne by us.
Please do not dispose of damaged products or packaging until we have advised you that it is appropriate to do so, as the courier may require the goods or packaging to be retained as part of a damage investigation.
Where we arrange delivery, Martin's Off-Licence remains responsible for the goods until they are delivered to you or to a person nominated by you to receive them.
If your order appears to be lost or has not arrived within the expected timeframe, please contact us and we will investigate the shipment with the relevant courier.
Your statutory rights in relation to delayed or non-delivered goods are unaffected by this policy.
Customers are responsible for providing complete and accurate delivery information and ensuring that an adult aged 18 or over is available to accept an alcohol delivery where required.
If a delivery cannot be completed because of incorrect or incomplete information supplied by the customer, refusal to accept the delivery, failure to accept the delivery, failure to provide satisfactory proof of age where requested, or another circumstance attributable to the recipient, you may be responsible for the direct costs of returning the parcel to us and/or attempting redelivery, where permitted by law.
Customers exercising a change-of-mind cancellation for an international order are responsible for the direct cost of returning the goods to Martin's Off-Licence, where applicable.
If an international parcel is already in transit when you request cancellation and we arrange for the courier to recall and return it, the direct return cost charged to us by the courier may be deducted from your refund.
International return costs can be significantly higher than domestic return costs. If you require an international order by a particular date, please contact us before ordering, as international delivery times are estimates unless a guaranteed delivery date has expressly been agreed with us.
