Alcohol may only be purchased by persons aged 18 years or over.
By placing an order containing alcohol, you confirm that you are aged 18 or over and that the person receiving the delivery will also be aged 18 or over.
Our staff and delivery partners may request satisfactory proof of age before releasing an order containing alcohol.
If the person accepting the delivery cannot provide satisfactory proof of age when requested, delivery may be refused and the goods may be returned to us.
Where a delivery is refused because satisfactory proof of age cannot be provided, any refund and any applicable delivery or return costs will be dealt with in accordance with our Refund & Returns Policy, Delivery Policy and your statutory consumer rights.
All prices displayed on our website are in Euro and include VAT and applicable duties unless otherwise stated.
Prices, promotions and product availability may change from time to time. Any changes will not affect an order that has already been accepted by us, except where there has been an obvious pricing error or where we contact you and you expressly agree to a change.
If there is an error in the price displayed for a product, or a price changes before we have accepted or fulfilled your order, we will contact you before dispatch. You will have the option to proceed at the corrected price or cancel the affected item/order and receive an appropriate refund.
Any applicable delivery charge will be clearly displayed during checkout before you complete your purchase.
Payment must be successfully completed before an order is dispatched.
Goods remain the property of Martin's Off Licence Limited until payment for those goods has been received in full.
We make every reasonable effort to ensure that stock information displayed on our website is accurate. However, because our online and physical store stock may be sold simultaneously, occasional stock discrepancies can occur.
Availability displayed on our website therefore does not constitute a guarantee that an item will be available when your order is processed.
Some products may be available to order from our suppliers even where they are not immediately available in our physical store. Where this applies, there may be an additional lead time. We will endeavour to make this clear or contact you regarding the expected timeframe.
Due to the nature of some of the products we sell, availability can occasionally be intermittent.
If a product you have ordered is unavailable, we will contact you and may offer:
A suitable alternative;
The option to wait for the product to become available; or
A refund for the unavailable product.
We will not substitute an unavailable product without your agreement.
Where a specific vintage is stated in the product title or description, we will endeavour to supply that vintage.
Where a specific vintage is not stated, the vintage supplied may occasionally differ from the bottle pictured on our website.
If a particular vintage is important to you, please contact us before placing your order and we will confirm availability.
We make every reasonable effort to ensure that product descriptions, images, vintages, bottle sizes and other information displayed on our website are accurate.
Product packaging, labels, vintages and presentation may occasionally be changed by producers or suppliers without notice.
Images are provided for illustrative purposes and minor differences in packaging or presentation do not necessarily indicate that the product supplied is incorrect.
If a material aspect of a product differs from what you ordered, your statutory consumer rights are unaffected.
Delivery charges, estimated delivery times, international delivery information, failed deliveries and other delivery conditions are set out in our Delivery Policy.
Delivery times are estimates unless Martin's Off-Licence has expressly agreed a guaranteed delivery date with you.
If you require an order for a particular date or event, please contact us before ordering. We cannot guarantee delivery by a particular date unless this has been expressly agreed with us in advance.
Nothing in these Terms & Conditions or our Delivery Policy affects your statutory rights in relation to delayed, damaged, lost or non-delivered goods.
For purchases made online or by phone, consumers generally have a statutory right to cancel an eligible order without giving a reason.
For most eligible purchases made at a distance, you may notify us that you wish to cancel at any time from placing your order until 14 days after you, or a person nominated by you, receive the goods.
Once you have notified us of your decision to cancel, you must generally return the goods to us within 14 days.
You may notify us of your decision to cancel by contacting us using the contact details provided above or by making any other clear statement informing us that you wish to cancel.
Certain goods may be excluded from the statutory cancellation right where permitted by law, including certain personalised goods, goods that deteriorate or expire rapidly and certain sealed goods that are not suitable for return for health or hygiene reasons once unsealed.

If you contact us to cancel an order before it has been dispatched, we will normally be able to cancel it without a delivery or return charge.
If you exercise your right to cancel after an order has already been dispatched, the shipment may need to be recalled or returned to us.
Where applicable, you will be responsible for the direct cost of returning the goods to us.
If the parcel is already in transit and you ask us to arrange for our courier to recall and return it, the direct return cost charged to us by the courier may be deducted from your refund.
Any refund of the original standard delivery charge will be dealt with in accordance with your statutory consumer rights.

Where a statutory change-of-mind cancellation right applies, goods do not necessarily have to remain completely unopened. You may inspect goods to the extent reasonably necessary to establish their nature, characteristics and functioning.
You may, however, be responsible for any reduction in the value of the goods caused by handling beyond what is reasonably necessary to inspect them.
Different rules apply where goods are faulty, damaged, not as described or otherwise do not conform to the contract. Nothing in our change-of-mind returns policy limits your statutory rights in those circumstances.
If goods arrive damaged, faulty, incorrect or otherwise not as described, please contact us as soon as reasonably possible.
We will deal with the matter in accordance with your statutory consumer rights.
Where goods are faulty or otherwise do not conform to the contract, you will not be required to bear return costs where the law requires those costs to be borne by us.
Customers are responsible for providing complete and accurate delivery information and, where appropriate, ensuring that an adult aged 18 or over is available to receive an alcohol delivery.
Where a delivery cannot be completed due to incorrect or incomplete information supplied by the customer, refusal of delivery, failure to accept the delivery, failure to provide satisfactory proof of age where requested, or another circumstance attributable to the recipient, the customer may be responsible for direct return and/or redelivery costs where permitted by law.

Promotional offers and discount codes may be subject to specific terms, including expiry dates, minimum spends, eligible products or customer restrictions.
Unless otherwise stated, promotional offers and discount codes cannot be exchanged for cash.
We reserve the right to withdraw or correct a promotion where there has been an obvious error, technical issue, misuse or other circumstance that makes the promotion unavailable, subject always to applicable consumer law.
